Gestern hat die US-Regierung hat eine neue Website unter http://icontherecord.tumblr.com/ online gestellt, auf der das Büro des Director of National Intelligence unter anderem Stellungnahmen abgibt sowie ehemals geheime oder vertrauliche Dokumente (teilweise geschwärzt) publiziert. Die Seite wurde von Präsident Obama in einer Pressekonferenz am 9. August angekündigt und soll ganz offensichtlich der Beruhigung der Gemüter in Bezug auf die NSA-Affäre dienen:

… the goal of IC ON THE RECORD is to provide the public with direct access to factual information related to the lawful foreign surveillance activities carried out by the Intelligence Community…

The highest priority of the Intelligence Community is to work within the constraints of law to collect, analyze and understand information related to potential threats to our national security.

As we work to deliver the most insightful intelligence possible, we must and will, without compromise, uphold the rule of law and respect the civil liberties and privacy of every American.

Es geht – wohlgemerkt – um die Privatsphäre jedes Amerikaners. Diese Unterscheidung wird detailliert in einem der bereits veröffentlichten Dokumente („Minimization Procedures“) ausgeführt. Der Abschnitt, der uns im Rest der Welt betrifft, ist sehr kurz – unter der Überschrift „Section 7 – Other foreign communications“ steht dort: „Foreign communications of or concerning a non-United States person may be retained, used and disseminated in any form in accordance with other applicable law, regulation, and policy.“

Im Kontext dieses Dokumentes heißt das: De jure genießen US-Bürger einen gewissen Schutz ihrer privaten Kommunikation, der dazu führt, dass nur in begründeten Ausnahmefällen diese Kommunikation gespeichert, analysiert und weitergeleitet werden darf – für Menschen aus allen anderen Ländern gilt dieser Schutz eben nicht. Keine Überraschung, aber doch nett, es nochmals so amtlich bestätigt zu bekommen.
